Non-compliance (button missing or non-compliant, no acknowledgement of receipt, no dated and enforceable proof, out-of-date T&Cs) moves the penalty closer to the ceiling. It is the customer's country of residence that sets the applicable law (Rome I, art. 6); this country is an example.
